You will not need to show up at the arraignment. I'll handle that and get the Complaint and the Discovery (police report and other evidence).

We will discuss the police report and focus on why you were stopped and the field sobriety tests. There are potential flaws in all the tests. Call me and I will explain them.

I will call the DA and speak with him or her to discuss the strengths of your case. Depending on the circumstances I may file motions to exclude evidence or to dismiss the case entirely. If you would like to see a sample of a motion please refer to the section to your right titled MOTION TO SUPPRESS.

We will attend a pre trial conference at court and discuss the case with the judge. In my opinion the DA's office would prefer to settle this case rather than go to trial, so they may wish to negotiate at this conference. That is the beauty of having an attorney who understands what you should be offered. Hopefully, this offer will save you both time and money. The better your case is presented the better the offer.

You will decide if you would like to go to trial or accept the offer. If you accept the offer I will hand you some forms to sign and I will return to change your plea. You will probably not be required to attend. Otherwise, you get your day in court.

You must contact the California DMV to request an Administrative Hearing within 10 days to protect your driving privileges.

Temporary driver licenses issued to DUI defendants expire after 30 days, but driving privileges will be extended until a DMV hearing has been held and decision rendered. If you win the California DMV hearing, your driving privileges will be protected until the court renders a decision.
